JUSTICE SATYAVRAT VERMA ORAL ORDER 5 18-08-2026 1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in connection with Kotwa PS Case No. 269 of 2021 registered for the offences punishable under Section 366A of the Indian Penal Code and Sections 8 and 12 of the POCSO Act. 3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent. 4. At this stage, the learned APP submits that from perusal of Annexure-1 to the anticipatory bail, it would manifest that petitioners had earlier moved before this Court seeking anticipatory bail by filing Cr. Misc No. 14724 of 2022 and Cr. Misc No. 16163 of Patna High Court CR. MISC. No.25454 of 2026(5) dt.18-08-2026 2/2 2022 and the same came to be rejected by a common order dated 10.8.2022 passed by the then learned Co-ordinate Bench after considering the case on merit. It is next submitted that petitioners against the order dated 10.8.2022 neither surrendered before the learned Trial Court nor moved before the Hon’ble Supreme Court assailing the said order rather it appears that petitioners were moving at their leisure and after nearly 4 years of the order dated 10.8.2022 in Cr. Misc No. 14724 of 2022 and Cr. Misc No. 16163 of 2022, the instant second anticipatory bail application has been filed. It is thus submitted that a person who does not respect the law, the court should not come to his/her rescue and the second anticipatory bail be dismissed with cost. 5. The learned counsel appearing on behalf of the petitioners is not in a position to rebut the submission of the learned APP. 6. After hearing the learned counsel for the parties, the Court is not inclined to entertain the second anticipatory bail application thus the same is dismissed with a cost of Rs. 10,000/- (Ten Thousand) which shall be deposited by the petitioners in the Legal Aid, Patna High Court Legal Services Authority.
