reason that the language employed in clause (iii) of the circular dated 26.07.2005 was incorrectly noticed.
3. It transpires that clause (iii) of the circular dated 26.07.2005, relied upon by the appellants, referred to technical resignation on or before 01.01.2004, due to which the petitioner was non-suited. The notification has been annexed along with review applications, in order to show that the correct language is ‘technical resignation on or after 1-1-2004’, which condition is met by the applicant-petitioner.
4.
Learned counsel for the appellants, upon instructions, admits that the correct expression contained in the said circular is ‘technical resignation on or after 1-1-2004’.
5. We, accordingly, find force in the contention of the applicant- petitioner that this Court was misled on facts with regard to the expression employed in the circular dated 26.07.2005. Once that be so, we are inclined to allow the review applications, and consequently the judgment dated 29.11.2025 passed in LPA-525-2017 and CWP-20332-2022 is recalled.
6. Let LPA-525-2017 and CWP-20332-2022 be placed before the appropriate Bench, as per roster.
7. Photocopy of this order be placed on the file of the connected case.
