1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1. That, this Hon'ble Court may kindly be pleased to set-aside the condition No.1 imposed in the impugned order dated 06.07.2026 (Annexure P-1) imposed by the Chhattisgarh Rent Control Tribunal Raipur (C.G.), which is in relation to the payment of 50% of the outstanding rent, which is mentioned in the order dated 06.11.2025 within 30 days from the passing of the order dated
06.07.2026.
10.2. Any appropriate writ, direction or order may also kindly be passed in favour of the petitioners, which this Hon'ble Court deems fit in the circumstances of the case.”
2. Learned counsel for the petitioner submits that petitioner is tenant of the respondent. On an application filed by the respondent under Section 12 of Chhattisgarh Rent Control Act, 2011 (hereinafter referred as Act, 2011) an order dated 06.11.2025 was passed against him and has directed to vacate the suit premises within a period of 30 days and to pay arrears of rent of Rs.2,61,912/- after adjustment of Rs.40,000/-. The order passed by the Rent Control Authority is challenged before Chhattisgarh Rent Control Tribunal, Raipur (hereinafter referred as ‘RCT’) in Appeal No.23 A/2026 along with an application for grant of interim
3 relief. The Tribunal while considering the application for grant of interim relief allowed the application in part with the conditions mentioned therein vide its order dated 06.07.2026. He submitted that in condition No.1, the Tribunal has directed to pay 50% of the arrears of the rent till 06.11.2025 within a period of 30 days and in condition No.2, there was a direction to pay arrears of rent from January 2024 till July, 2026. He submits that if the conditions imposed is to be complied with then petitioner herein is required to pay double the rent for the period from January, 2024 till 06.11.2025 and therefore, this writ petition is filed.
3. When question was posed by this Court to the counsel for the petitioner as to whether any application is filed by the petitioner herein before the RCT for modification/correction of the interim
order in view of the ground raised before this Court. Counsel for the petitioner submits that according to his instructions no such application was filed.

It is also submission of learned counsel for the petitioner that in the order of the RAC there is a submission of petitioner made before the RCA that the rent for the period from the year 2017 till the year 2023 is paid to the brother – Laxman Agrawal of the applicant therein and it is also recorded.
5. Considering the facts and circumstances of the case, nature of the grounds raised in this writ petition it is appearing that grievance of the petitioner herein is that he wants
4 modification/correction in condition No.1 & 2 in order dated 06.11.2025 passed by RCT on the ground that by the conditions petitioner is directed to pay arrears of rent twice for same period. If that is so, the petitioner is having the remedy to file appropriate application before the RCT.

In above facts of this case, this writ petition is disposed of permitting the petitioner to submit appropriate application before RCT seeking modification/correction with respect to conditions No.1 & 2 in the interim order and if such an application is filed, the learned Tribunal shall consider and decide the same in accordance with law, considering the facts available therein.
7. Accordingly, this petition is disposed of with aforesaid observations and directions. Certified copy as per rules.
