NARENDRA PRASAD ORAL ORDER This Writ Petition is filed under Article 227 of the Constitution seeking for a direction to the XLI Addl. City Civil and Sessions Judge at Bengaluru (for short the ‘Trial Court') to dispose of I.A. Nos.1 and 2 of 2024 filed by the petitioner/plaintiff in O.S. No.2509/2024. 2. Petitioner being the plaintiff before the Trial Court has filed a suit for damages and permanent injunction against the defendant. Along with the plaint, he has also filed an application i.e., I.A. No.1/2024 under Order XXXIX Rules 1 and 2 read with Section 151 of CPC as well as I.A. No.2/2024 under Order XXXVIII Rule 5 read with Section 151 of CPC. - 3 - HC-KAR NC: 2026:KHC:18627 WP No. 9117 of 2026 3. The Trial Court has not granted any ex-parte order of injunction and has issued notice to the respondent/defendant. After service of summons, the respondent has appeared and filed objections to the said applications. The said applications i.e., I.A. Nos.1 and 2 filed by the plaintiff have not yet been disposed of. Therefore, the petitioner is before this Court seeking early disposal of the said applications. 4. In view of the above, without expressing any opinion on the merits of the case, the Trial Court is directed to dispose of the applications filed by the plaintiff in accordance with law, as expeditiously as possible, but not later than three months from the date of receipt of a certified copy of this order.
