LISA GILL, CJ (Oral): Present Writ Appeal has been filed for setting aside judgment and order dated 25.11.2025 passed in W.P.No.5620 of 2017. 2. Learned counsel for appellant submits that a number of issues have been raised in the writ petition, including the question of enhancement of Assignment Fee, Ground Rent, etc., vide G.O. dated 09.10.2013. However, the writ petition was dismissed as infructuous on the premise that lease period came to an end on 30.09.2018 and was never extended in favour of writ petitioners, i.e., present appellants. It is contended that issues so raised are relevant and ought to have been adjudicated, as their non-consideration would have wider implications. HCJ & NJSJ WA_589_2026 3. Learned counsel for respondents is unable to deny the same. 4. Keeping in view the facts and circumstances as noted above, judgment and order dated 25.11.2025 is set aside and the matter is remanded to learned Single Judge to decide afresh. There is no expression of opinion on merits as such. 5. Registry is directed to list W.P.No.5620 of 2017 before the appropriate Bench having Roster. Writ Appeal is allowed accordingly. No costs.
