And In the matter of : Sk. Rosen @ Rooshan Ali. ……Petitioner. Mr. Amitabha Karmakar .....for the Petitioner. Mr. Suman Chakraborty ……for the State. Learned advocate appearing for the petitioner submits that over the issue of parking there was certain dispute, for which the present case has been was initiated and subsequently petitioner is being threatened of arrest. It has also pointed out that there two persons are involved in the present case and one of them has been granted anticipatory bail by the learned Sessions Court. Learned advocate appearing for the State submits that there is no injury report which has been forwarded in the Case Diary. Having considered the same and the charge-sheet having been submitted, I am of the opinion that custodial detention may not be warranted. Accordingly, the prayer for anticipatory bail of the petitioner is allowed. As such, I direct that in the event of arrest, the petitioner shall furnish bond subject to the satisfaction of the investigating 2 officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 1787 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
