JUSTICE DR. ANSHUMAN ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner apprehends arrest in connection with G.R. No. 1774 of 2026 arising out of Bengusarai Town P.S. Case No. 182 of 2026 lodged on 10.04.2026, for the offence punishable under Sections 316(2), 318(2) and 303(2) of the BNS, 2023. 3. As per the prosecution case, the allegation made in the FIR is that the petitioner fled away after taking 90 grams of gold belonging to the informant from the shop where the petitioner was working, thereby causing a loss of approximately Rs.12 lakh to the informant. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits
Patna High Court CR. MISC. No.55934 of 2026(2) dt.19-08-2026 2/3 that the petitioner admits that he was working in the informant's shop as a karigar; however, the allegation of committing theft of gold is absolutely false. It is submitted that the petitioner had demanded payment of his outstanding salary and, with a view to deprive him of his legitimate dues and to teach him a lesson, the informant has falsely implicated the petitioner in the present case. Learned counsel further submits that the petitioner had filed a complaint before the Labour Superintendent, Begusarai on 28.03.2026 regarding non-payment of his dues. The said complaint was communicated to the owner/informant, and only thereafter, with an intention to retaliate against the petitioner, the present case was instituted. Learned counsel submits that the petitioner has clean criminal antecedents and is ready and willing to abide by any condition that may be imposed by this Court. 5. Learned counsel for the State vehemently opposes the prayer for bail and submits that there is a specific allegation in the FIR against the petitioner that he committed theft of 90 grams of pure gold belonging to the informant. 6.
Upon perusal of the materials on record, it transpires that the petitioner had lodged a complaint before the Labour Superintendent, Begusarai on 28.03.2026 regarding his
