Kausik (Rejected) CRM (M) 1401 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhimpur Police Station Case No. 267 of 2025 dated 03.10.2025 under Sections 103/3(5) of the BNS, 2023. And In the matter of : Sadhana Biswas ……Petitioner. Mr. Sumanta Das ……for the Petitioner. Mr. Bhaskar Seth Ms. Rima Banerjee ……for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for more than 9 months. Charge sheet has been submitted but other accused persons have been granted bail by this Court. As such, petitioner may be released on bail on any stringent condition. Learned advocate for the State opposes the prayer for bail, relies upon the statement of the mother of the deceased under Section 183 of the BNSS. The report submitted reflects that one witness has been examined and date has also been fixed for CSW 2 and CSW 4. I have taken into account the locus of the accused persons who have been granted bail including that of the petitioner. I find there is a difference between the degree of 2 culpability between the accused persons and the present petitioner. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. Petitioner would renew his prayer for bail after the evidence of the vulnerable witnesses are over. Accordingly, CRM (M) 1401 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
