Learned advocate appearing for the petitioner submits that the petitioner is in custody for 139 days, charge-sheet has already been submitted, as such petitioner be released on bail as both the petitioner and the victim are adults. Learned advocate appearing for the State has referred to the statement under Section 183 of the BNSS. I have taken into account the statement of the victim and I am of the opinion that a child was born by the relationship and the accusations are that the petitioner is a married person who committed the alleged offence. Having regard to the totality of circumstances, at this stage, I am not inclined to release the petitioner on bail. Petitioner will renew his prayer for bail after the evidence of victim is over before the learned trial Court. 2 Accordingly, CRM (M) 1414 of 2026 is rejected. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
