28 23.07. 2026 Ct. No. 18 Ab WPA 10162 of 2026 Sarwan Kumar Mahato Vs. The Chairman, Coal India and others. --------------- Mr. Guddu Singh. … for the petitioner. Mr. Manik Das. … for the respondent nos. 2 to 7. 1. The petitioner has challenged a disciplinary proceeding by which he has been held guilty of charges leveled against him. 2. Mr. Das, learned Advocate appearing for the respondent nos. 2 to 7, submits that there is a provision for statutory appeal which the petitioner has not availed. 3. Mr. Singh, learned Advocate appearing for the petitioner, fairly submits that the appeal has been preferred, but before the wrong authority. 4. In view thereof, the writ petition is disposed of granting liberty to the petitioner to prefer the appeal before the correct Forum. The Appellate Forum will consider the issue of limitation, taking into account the fact that the petitioner had approached the wrong Forum and had also approached this Hon’ble Court to ventilate his grievances under a wrong impression. 5. This issue of limitation will be considered favourably only if the appeal is preferred by August 20, 2026. 2 6. There shall, however, be no order as to costs. 7. Since affidavits have not been called for, the allegations contained in the petition are deemed to be denied. 8. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Reetobroto Kumar Mitra, J.)
