The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.329/2025, registered at Police Station – Gobra Nayapara Raipur, District - Raipur (C.G.) for the offence punishable under Sections 64(2)(m), 351(2) of the Bharatiya Nyaya Sanhita, 2023, and Section 67 of the Information Technology Act, 2000.

The case of the prosecution, in brief, is that the complainant lodged a report at the concerned Police Station alleging, inter alia, that on the date of the incident, the present applicant established sexual intercourse with the victim on the false pretext of marriage and also recorded a video of PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.07.29 16:09:01 +0530
2 the act. It is further alleged that, thereafter, the applicant refused to marry the victim. On the basis of the complaint lodged by the victim, the police registered Crime No. 329/2025 against the present applicant for the offences punishable under Sections 64(2)(m) and 351(2) of the Bharatiya Nyaya Sanhita, 2023, and Section 67 of the Information Technology Act,
2000.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant has been in judicial custody since 19.08.2025. It is submitted that the trial is in progress, and the statements of the victim as well as the doctor have already been recorded. It is further submitted that the charge-sheet has already been filed and that the applicant has no previous criminal antecedents. As the conclusion of the trial is likely to take considerable time, it is prayed that the applicant be enlarged on regular bail.
4. On the other hand, the learned State counsel opposed the bail application and submitted that the charge-sheet has already been filed. He further submitted that, as per the statement of the victim recorded under Section 183 of the BNSS, 2023, the applicant had called the victim, who is a married woman, on the pretext of providing her employment and thereafter sexually exploited her. It is further alleged that the applicant had taken her photographs and threatened to send the same to her husband. Accordingly, the present bail application deserves to be dismissed.
5. I have heard learned counsel for the parties and perused the documents available on record.
6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations, the material collected during the
3 course of investigation, the fact that as per the statement of the victim recorded under Section 183 of the BNSS, 2023, the applicant had called the victim, who is a married woman, on the pretext of providing her employment and thereafter sexually exploited her, further the applicant had taken her photographs and threatened to send the same to her husband, also considering the fact that the trial is in progress and the statements of the victim and the doctor have already been recorded, no
order-sheet or proceedings of the Trial Court evidencing the recording of their statements have been annexed along with the present bail application, in view of the statement of the victim recorded under Section 183 of the BNSS and the material available on record, this Court is not inclined to grant regular bail to the applicant.

Accordingly, the bail application of the applicant - Sagar Jamwal involved in Crime No.329/2025, registered at Police Station – Gobra Nayapara Raipur, District - Raipur (C.G.) for the offence punishable under Sections 64(2)(m), 351(2) of Bharatiya Nyaya Sanhita, 2023 and 67 of I.T. Act, is rejected.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
