ORAL ORDER
A common joint memo is filed, which reads as under:
“COMMON JOINT MEMO The Petitioner / accused and Respondent/ Complainant most respectfully submit as follows:

1. The parties submit that they have amicably settled all their disputes in respect of both the above cases. 2. The total cheque amount involved in both the cases is Rs.6,00,000/- (Rupees Six lakhs only). 3. Both parties submit that out of the said amount a sum of Rs. 1,20,000/- has already been deposited before the Trial Court and a sum of Rs.1,00,000/- has already been paid before this Hon'ble Court. In total Rs.2,20,000/- has already been paid. 4. The balance amount payable is Rs.3,80,000/- (Three lakhs eighty thousand only), the petitioner/accused has agreed to pay the said balance amount to the respondent/complainant by way of Bank Transfer to the complainant 's Bank Account as detailed below: Account Holder Name: SRI. K.L. SHYAMSUNDAR S.B Account No. 410091403 IFSC Code: IDIB000A038 Bank: INDIAN BANK, Avenue Road Branch Bengaluru. 5. It is agreed by the petitioner/accused the aforesaid balance amount of Rs.3,80,000/- to be paid in the following manner on or before below mentioned date: 1st Installment date: 29-04-2026 .... Rs. 80,000/- 2nd Installment Date: 29-05-2026 .... Rs. 1,00,000/- 3rd Installment Date: 29-06-2026 .... Rs. 1,00,000/- 4th Installment Date: 29-07-2026 .... Rs.1,00,000/-

6. The petitioner/accused undertakes to strictly adhere to the above payment schedule within time without any default. 7. The above settlement and payment shall be treated as full and final settlement of both the cases. 8. The petitioner/accused undertakes that, in the event of default in payment of any one installment shall be treated as admission of guilt in both the cases. And in default of payment, the complainant/respondent is at liberty to take action in accordance with law by way of issuing non- bailable warrant against the accused without requiring any separate application. 9. Upon compliance of the above terms the respondent/complainant agrees to treat both the cases as fully settled.
PRAYER WHEREFORE, both the parties humbly prays that this Hon'ble Court be pleased to: a) Record this Common Joint Memo in both the cases; b) Permit payment of the installments as stated above; balance amount in c) Pass such other order/s as deemed fit in the interest of justice and equity.”

2. Placing the common joint memo on record, the petitions stand disposed of. 3. The amount in deposit is ordered to be withdrawn by the complainant under due identification. 4. It is made clear that, if there is default in payment of the fine amount as agreed in the memo, the petitioners shall undergo imprisonment as ordered by the Trial Magistrate confirmed by the First Appellate Court.
