SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of Certiorari for quashing the Impugned Speaking Order dated 29.12.2025 (Annexure P-2) passed by respondent no.4 being illegal and contrary to the provision of law and the facts of the case and further issuance of a writ in the nature of Mandamus directing the respondents to grant retiral benefits including family pension, retirement gratuity, general provident fund and incentive contributory fund and other benefits alongwith arrears and interest @ 9% p.a. After arguing for some time, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to pursue the case if the cause of action survives duly supporting his assertion that husband of the petitioner is missing since 1985 by proving the said fact strictly in accordance with law. Prayer is accepted. Dismissed as withdrawn with liberty aforesaid.
