Civil Judge (Jr Dn) and JMFC Court, Hoskote at Bangalore Rural - 4 - HC-KAR CNR: KAHC010384832026 NC: 2026:KHC:36243 CRL.P No. 8074 of 2026 District, for the offences under Sections 316(2), 318(4), 61(2) of Bharatiya Nyaya Sanhita, 2023. 2. Heard Sri.Afroz Pasha, learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.Rajesh S.R learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “JOINT AFFIDVAIT We Madan M, S/o Muniraj, aged about 26 years Residing at Makanahalli Village, Anugondanahalli Hobli Hosakote Taluk Bangalore District Karnataka - 560114 today at Bangalore city AND Smt. H M Yallamma, W/o Late Rajappa Aged about 56 years, Residing at D Hosahalli Village Anugondanahalli Hobli, Hosakote taluk Bengaluru District Karnataka- 560117 today at Bangalore city do hereby solemnly affirm and state on oath as follow. 1. I Madan M, accused/petitioner no 3 in the above case and I am fully conversant with the facts of the case and I - 5 - HC-KAR CNR: KAHC010384832026 NC: 2026:KHC:36243 CRL.P No. 8074 of 2026 am swearing to this affidavit on behalf of accused petitioner no 1, 2 and 4 also. 2. I H M Yallamma I am the complainant in the above case and I am fully conversant with the facts of the case and I am swearing to this affidavit. 3. We submit that, we have filed an application u/s 359 (2) OF BNSS to compound the offences in the above criminal petition. 4. That, the disputes between us have been resolved and we have decided to settle the matter between them. 5. I H M Yallamma states that, I had invested amount with the Petitioner's company and they have already paid the profit of Rs 179996.41 07th December 2024 and sum of Rs 282821.38 on 22nd March 2025 towards the profit and they have also paid the sum of Rs 500000 on 07/03/2026 and later the after the registration of the present the complaint, they paid remaining sum of Rs 500000/ on 1st June 2026 towards the principal outstanding. 6. That, Petitioner's company have agreed to pay remaining outstanding amount of Rs 3,40,300 by way of demand draft on or before 06/08/2026. 7. That, till such time for the purpose of payment security, I 3rd Petitioner is issuing my personal bank account postdated cheque bearing cheque No 085311 for sum of Rs 3,40,300 account No 6452500100407001 drawn at Karnataka bank Ltd dated 10/08/2026 in favour of complainant. 8. That, I complainant herein is agreed that, i will return the above a postdated cheque bearing cheque No 085311 Rs 3,40,300 account No 6452500100407001 drawn at Karnataka bank Ltd dated 10/08/2026, after the receipt of the demand draft for sum of Rs 3,40,300 on or before 06/08/2026. 9. That, I 3rd Petitioner personally undertakes to honour the above postdated cheque bearing cheque No 085311 - 6 - HC-KAR CNR: KAHC010384832026 NC: 2026:KHC:36243 CRL.P No. 8074 of 2026 account No 6452500100407001 drawn at Karnataka bank Ltd dated 10/08/2026, if the company fails to provide the demand draft for sum of Rs 3,40,300 on or before 06/08/2026. 10. I H M Yallamma states that, I have agreed to withdraw the NI act case filed in PCR No 197/2026 pending before the Prl Civil Judge and JMFC Hosakotte Bangalore rural related to the cheque bearing no 531535 for sum of Rs 10,00,000/, bearing account no 42610515368 drawn at SBI bank issued by the Cipher crypto Technologies, against the company represented by the 1st and 2nd Petitioner as the cheque amount of Rs 1000000 is already been paid by the Petitioners as stated in the para no 5. 11. 11. I H M Yallamma states that, that after withdrawing the above PCR No PCR No 197/2026 pending before the Prl Civil Judge and JMFC Hosakotte Bangalore rural case i will she will return the original cheque bearing no 531535 for sum of Rs 10,00,000 bearing account no 42610515368 drawn at SBI bank issued by the Cipher crypto Technologies along with the original agreement at the times of receipt of the demand draft on or before 06/08/2026. 12. I H M Yallamma states that, further I have agreed to return the cheque bearing no 085302, for sum of Rs 500000/ bearing account No 6452500100407001 drawn at Karnataka Bank Ltd today issued by the 3rd Petitioner Madan M in favour of me as the amount is already been settled for the complainant. 13. That, I 3rd Petitioner Madan M that, we have also executed an MOU in favour of the complainant's son Harish Kumar R related to his investment for the return of his principal amount of Rs 500000/ separately and same will be honoured without fail as per the terms of the agreement. 14. I HM Yallamma stated that, I will agree to file necessary application through my son Harish Kumar R to the concern authority to unfreeze the following bank - 7 - HC-KAR CNR: KAHC010384832026 NC: 2026:KHC:36243 CRL.P No. 8074 of 2026 account of the Petitioner's company which are blocked on the complaint of me and her son Harish Kumar R. A. SBI bank account bearing account No 42610515368, IFSC code SBIN0017650 B. SBI bank account bearing account No 37346413626, IFSC code SBIN0017650 15. I H M Yallamma states that, me and son Harish Kumar have no other claims against the Petitioner's company and its employees after realisation of the respective cheques issued to us. 16. I H M Yallamma and my son Harish Kumar R agreed that we shall not publish, circulate, upload, communicate or disseminate any false, defamatory, derogatory or misleading statement concerning the Petitioner's company, its directors, representatives, employees or business through social media, electronic media, print media, messaging applications or any other mode of communication. 17. We submit that, the above offences are compoundable with the permission of this Hon'ble court and That, this Hon'ble court have jurisdiction u/s 528 of BNSS to quash the entire FIR basis settlement between the parties. 18. We submit that, we have settled our disputes with own will and wish without any influence or force. What is stated above is true and correct to the best of my knowledge, information and belief. wherefore it is most respectfully prayed that this Hon'ble may please to: A. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.65/2026, pending before the Prl.
