Learned Senior Counsel appearing for the petitioners invited the attention of the Court to the order dated 30.06.2015 in Appeal No.529/2007 (Annexure-A), wherein the appeal came to be allowed by the Karnataka Appellate Tribunal (for short, 'KAT') and the matter was remitted to respondent No.2 herein, to reconsider the issue after conducting the spot inspection. 3. In this regard, learned HCGP submitted that the Writ Appeal No.66/2024 is pending consideration before the Division Bench of this Court, as to the issue involved in this petition. - 4 - HC-KAR NC: 2026:KHC:35787 WP No. 17308 of 2021 4. However, having taken note of the submission made by the learned counsel appearing for the parties and on careful consideration of the finding recorded by the KAT in the order dated 30.06.2015 (Annexure-A) in Appeal No.529/2007, wherein the matter was remitted to respondent No.2 herein to reconsider the issue as to the possession of the land in question and to raise the penalty to be imposed on the petitioner is concerned. 5. In that view of the matter, respondent No.2 is directed to reconsider the representation produced at Annexure-F dated 15.01.2021, in accordance with the direction issued by the KAT in Appeal No.529/2007 dated 30.06.2015 (Annexure-A), in respect of the land measuring 7.08 acres in Survey No.8/1 and to an extent of 5.19 acres in Survey No.8/4 of Chokkanahalli Village, Yelahanka Taluk, within a period of four (4) months from the date of receipt of this order. - 5 - HC-KAR NC: 2026:KHC:35787 WP No. 17308 of 2021 6. However, it is made clear that any decision that may be taken by respondent No.2 shall be subject to the result of the judgment that may be passed in W.A.No.66/2024. 7.
