The petitioner had participated in the recruitment process for the post of Instructor at Government I.T.Is. initiated by the notice dated December 31, 2024. 2. The petitioner had applied as a General category candidate by way of online application. The closure of receipt of the online application was February 17, 2020. 3. The petitioner has now approached this Hon’ble Court on the ground that he seeks migration of his category, from General to OBC(A). This certificate, relied upon by Mr. Chowdhury, learned Advocate appearing for the petitioner, is dated June 11, 2020. Clearly, the certificate was obtained well after the closure of the last date for receipt of online 2 application. 4. The petitioner seeks entitlement to a vacancy in the category of OBC(A) by virtue of this certificate, which was obtained by him much after closure of the receipt of the online application form. 5. Irrespective of a valid panel, this much is clear that at the time of applying, which the petitioner had done under the General (Unreserved Category). If the petitioner is permitted to change/migrate from his category to the category of OBC(A), as sought for by him, that will lead to disruption of entire process. It will result in affording a discriminatory treatment to the petitioner favourably. There may be other candidates similarly situated as the petitioner, who have got their certificates after the last date for receipt of the online application, thus, claiming a similar entitlement as the petitioner. 6. The entire process cannot be disrupted by the petitioner, who had chosen to apply in the General category, at present, after six years, only because he had obtained the certificate for Other Backward Classes sometime in June 2020. 7. There is absolutely no entitlement of the petitioner to disrupt the process or change his category from General to OBC(A). 8. In view thereof, WPA 13627 of 2026 fails and is dismissed. 3 9. There shall, however, be no order as to costs. 10. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Reetobroto Kumar Mitra, J.)
