Learned senior counsel for the petitioners has invited the attention of the Court to the notification dated 20th May, 2023 whereby the competent authority prescribed the number of stage carriages and special stage carriages to be operated in City routes on the particular routes. In the said notification, the relevant route is “Sealdah to Howrah Maidan” known as route no. 28. Learned counsel submits that pursuant to this, the petitioners were granted stage carriage permit which is valid till December, 2009. 2. Learned senior counsel for the petitioners further submits that the Commissioner of Police, Kolkata vide a notification dated 11th June, 2012 2 imposed some restrictions on the moment of vehicles in view of the construction work of East West Metro Railway Corporation. Learned senior counsel submits that the terminus of the route no.28 was to be relocated to Barafkal terminal. Learned senior counsel submits that this work had been completed since long, however, the restrictions are still continuing without any reason. 3. Learned senior counsel submits in this regard they serve a notice upon the Commissioner of Police and the Transport Authorities dated 2nd April, 2026 requesting therein to issue necessary clarification regarding the termination of the notification dated 11th June, 2012 issued by the Commissioner of Police, Kolkata. Learned senior counsel submits that however the authorities have failed to respond to such notice. 4. Learned Jr. Govt. Pleader seeks time to take instruction. 5. Learned senior counsel for the petitioners submits that petitioners would be satisfied if an appropriate direction is issued to the Commissioner of Police, Kolkata/respondent No.5 to consider the communication dated 2nd April, 2026 expeditiously and convey the decision to the petitioners. 6. In view of the submissions made, Commissioner of Police, Kolkata is directed to 3 consider the representation dated 2nd April, 2026 preferably within two weeks after giving the parties an opportunity of being heard. The Commissioner of Police shall convey the decision to the petitioners within one week of taking of such decision. 7. Learned senior counsel for the petitioner on instruction states that in above circumstances the petitioner does not want to further pursue the petition with liberty to file fresh petition, if required, in accordance with law. 8. Liberty granted. 9. Accordingly, the petition is disposed of. 10. All parties shall act in terms of server copy of the order duly downloaded from the official website of this Court.
