PATTANAIK Order No. ORDER 18.02.2026 02. 1. The ABLAPLs are disposed of by the following common order. 2. Heard learned counsel for the respective parties. 3. Instant petitions under Section 482 BNSS are filed seeking pre-arrest bail of the petitioners in connection with T.R. Case No.22 of 2025 pending in the file of learned Session Judge-cum-Special Judge, Jeypore arising out of Jeypore Sadar P.S. Case No.93 of 2025 on the grounds stated. 4. Perused the FIR as at Annexure-1. The alleged incident is narrated in the report and it is made to appear that the local police intercepted the vehicles, the details of which are mentioned therein, while transporting commercial quantity of contraband Ganja. It is further made to reveal from Annexure-1 that the petitioners surrounded the police officials and obstructed them in performing duty after the vehicles were detained by them. The names of the petitioners are mentioned in the FIR i.e. Annexure-1. The Court finds that the petitioners have not been alleged of being involved in illicit transportation of the contraband substance but committed the mischief at the spot after the vehicles were intercepted by the police. It is claimed that the petitioners, who are the wives of the principal accused, are not having any similar antecedent. Recorded the p. 3 objection of the State, according to whom, large quantity of contraband Ganja has been transported and, in that connection, the petitioner did the mischief at the relevant point of time after the vehicles were detained by the police. Considering the above facts and submission of learned counsel for the petitioners and the mischief committed by them, this Court, having regard to the fact that the principal accused and others are alleged to be directly responsible for the transportation of Ganja, though, not inclined to grant any of them pre-arrest bail but is of the view that the petitioners should be directed to surrender before the learned court below for being released with stringent conditions and accordingly, it is ordered. 5. In the result, the ABLAPLs are disposed of with the direction as aforesaid. In the event, the petitioners surrender before the court of learned Session Judge-cum-Special Judge, Jeypore within a fortnight from today, it is directed that they shall be released on bail in connection with T.R. Case No.22 of 2025 corresponding to Jeypore Sadar P.S. Case No.93 of 2025 on furnishing bail bonds of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Rojina Designation: Junior Stenographer
