JUSTICE M.G.S. KAMAL ORAL ORDER This writ petition is filed by the petitioners in view of the notices dated 20.10.2016 and 26.12.2016 produced at Annexure-A & Q respectively issued by respondent Nos.3 and 4 Vijaya Bank and its Identification Committee. By Annexure-A, respondent No.3 has called upon the petitioners to show-cause, why their name shall not be published in the list of willful defaulters, within 15 days from the date of receipt of the said notice. It appears thereafter, matter has been taken up by the Identification Committee of respondent No. 3-bank. 2. The contents of notice dated 26.12.2016 Annexure- Q indicate that the petitioners herein had sought for adjournment of the hearing, which was granted on three occasions and the said communication further indicate the matter was posted on 29.12.2016 before the Identification Committee and that, if the petitioners did not appear on the said date decision would be taken ex-parte and further proceedings would be initiated. It is at this juncture the petitioners have filed this writ petition on 11.01.2017. - 5 - HC-KAR NC: 2026:KHC:34871 WP No. 1613 of 2017 3. Learned counsel for respondent No.3-bank drawing attention of this Court to paragraph No.4.14 of Statement of Objections submits that, subsequent to the communication at Annexure-Q of the writ petition, the Identification Committee had conducted the proceedings and after considering the submissions made by the petitioners and after due deliberation, in the light of RBI guidelines, classified petitioner No.1 - company and its directors as willful defaulters. 4. He further submits that the petitioners had also filed WP No.6673-6675/2017 subsequent to passing of the order of the Identification Committee which has also been disposed of. 5. At this juncture, learned counsel for the petitioners submits that the proceedings concerning the petitioners is pending consideration before NCLT at Ahmedabad, and the order passed by respondent No.4 - Identification Committee would be subject to the outcome of the said proceedings before the NCLT. 6. Be that as it is, the aforesaid facts and the subsequent events as narrated in the Statement of Objections - 6 - HC-KAR NC: 2026:KHC:34871 WP No. 1613 of 2017 referred to above, indicate the petition has lost its efficacy and no purpose will be served. 7.
