Accused Nos.1 to 3 in Crime No.33/2026 registered by Bellavi Police Station, Tumakuru, for offences punishable under Section 109, 115(2), 351(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (BNS) are before this Court in this petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking anticipatory bail. 2. Heard learned counsel for the petitioners and learned Addl. SPP for the respondent-State. 3. FIR in Crime No.33/2026 was registered by Bellavi Police Station, Tumakuru, for the aforesaid offences against petitioners herein based on the first information dated 17.05.2026 received from Srinivasaiah, who is the injured victim in the present case. Apprehending arrest in the case, petitioners had filed Crl.Misc.No.769/2026 before the jurisdictional Sessions Court, which was rejected on 29.05.2026. From a reading of the first information submitted by the alleged victim, it is found that accused Nos.1 and 2 are the son and daughter-in-law of the alleged victim and accused No.3 is his wife. It appears that there is some dispute between the family members with regard to certain property and it is in this background, accused Nos. 1 to 3 had allegedly had fought with the victim and had assaulted him. Wound Certificate of the alleged victim would go to show that he had suffered only simple injuries in the said incident. Injury No.1 is an abrasion and injury No.2 is a cut on his left hand ring finger. Petitioners have not used any weapon for assaulting the injured. Petitioners do not have any criminal antecedents and they have undertaken to co-operate with the Police for the purpose of investigation. 5. Accordingly, the following; ORDER (i) The petition is allowed. (ii) The respondent – Police or any other police in the State of Karnataka are directed to release the petitioners- accused in the event of their arrest in Crime No.33/2026 - 5 - HC-KAR CNR: KAHC010368572026 NC: 2026:KHC:37051 CRL.P No. 7781 of 2026 registered by Bellavi Police Station, Tumakuru, for offences punishable under Section 109, 115(2), 351(2), read with 3(5) of BNS, subject to the following conditions: a) The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond before the concerned Court, for a sum of Rs.1,00,000/- each with one surety for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witnesses and shall co-operate with the police for investigation and appear before them whenever called upon. d) The petitioners shall not involve in similar offences in future.
