Learned counsel for the petitioner has placed on record a receipt dated 25.03.2026, issued by the Member Secretary, H.P. Legal Services Authority, Kasumpti, Shimla, regarding the deposit of ₹12,300/-, which is 7.5% of the cheque amount.

Learned counsel for the respondent/complainant, under instructions, submits that matter has been reconciled

between the parties and the respondent/complainant does not want to proceed further with the complaint in view of the compromise effected between the parties.

In view of above, the present revision is allowed and the judgment passed by learned Sessions Judge, District Sirmour at Nahan H.P. (learned Appellate Court) on 19.01.2026 in Criminal Appeal No. 57-Cr.A/10 of 2025 affirming the judgment of conviction and order of sentence dated 27.05.2025, passed by learend Chief Judicial Magistrate, Nahan, District Sirmour, H.P. in Complaint No. 308 of 2022 are ordered to be set aside.

Learned counsel for the petitioner submits that an amount of ₹42,000/- has been deposited before the learned Trial Court, which is to be disbursed to the petitioner/accused. Learned counsel for the respondent/complainant submits that whole amount has been paid to the respondent/complainant and to this effect a no objection certificate has been issued, hence, the amount, so deposited before the learned Trial Court is ordered to be disbursed in favour of the petitioner/accused by remitting the same in his bank account on furnishing of bank details, if not

furnished earlier.

In view of the above, the present petition is disposed of, so also the pending miscellaneous application(s), if any
