IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT APPEAL NO: 687 of 2026 Bench Sr.No:-81 [3579] Nalliboyina Nagaraju and others ...Appellants Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for Appellants: Mr. Tagore Yadav Yaragorla Advocates for Respondents: GP for Irri. and CAD – R4, GP for Fisheries – R1, 2, 4 to 6, Mr. Bolla Venkata Rama Rao (SC For A.P.P.C.B.) – R3
CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE NINALA JAYASURYA DATE : 15th June, 2026.
LISA GILL, CJ (Oral):
This Writ Appeal has been filed by appellants (respondent Nos. 8 to 10 & 12 in the Writ Petition), being aggrieved of interim order dated 08.05.2026 passed in I.A.No.1 of 2026 in W.P.No.21804 of 2025.
2.
Learned counsel for appellants raises a number of arguments, including the one that learned Single Bench has factually erred in directing respondent authorities to consider objections of writ petitioners for conversion of agricultural land into fish tanks, while taking note of memo dated 29.12.2022 issued by Commissioner of Fisheries, Vijayawada. It is submitted that memo dated 29.12.2022 was specifically revoked by memo dated 19.09.2025.
HCJ & NJSJ WA_687_2026
3. Moreover, learned Single Bench has not considered the fact that license in question was granted after calling for objections from all adjacent/neighbouring farmers of the present writ petitioners. Writ petitioners are not neighbouring or adjacent farmers, and their lands fall more than 300 meters away. It is further submitted that valid license issued in favour of appellants is not even under challenge in the Writ Petition.
4. We have heard learned counsel and have perused the file.
5. At this stage, without expressing any opinion on merits of matter, liberty is afforded to appellants to file an appropriate application before the writ Court bringing to its notice all these factual aspects. The matter is stated to be listed on 09.07.2026. Liberty is also afforded to appellants to file appropriate application for preponement of hearing in view of urgency as is stated before us.
6. With the said observations, Writ Appeal is disposed of.
No costs. Pending miscellaneous application(s), if any, also stand(s)
disposed of accordingly.
