1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to grant intra-District transfer to the petitioner to a school nearby her place of residence.
3. This is second round of litigation.
4. Previously, the petitioner filed a writ petition being WPA 1542 of 2024 which was disposed by order dated 25th June, 2024 directing the Chairman, District Primary School Council, South 24-Parganas to dispose of the representation of the petitioner in accordance with law subject to availability of vacancy and after complying with all necessary Rules including the Pupil- Teacher Ratio. Pursuant to such direction reasoned
order was passed by the Chairman, District Primary School Council, South 24-Parganas on 3rd September, 2024 rejecting the prayer of the petitioner on the
2 ground that if the concerned teacher is transferred, the school will become a single teacher school which is adverse to Rule 3 of the West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002. The petitioner presently is functioning as an Assistant Teacher in Gobordhanpur Amuylyacharan F.P. School, Village Gobordhanpur, P.O. Buraburirtat, Police Station Patharpratima District South 24-Parganas.
5. Mr. Bapin Baidya, learned Advocate appearing on behalf of the petitioner submits that presently, the school has three teachers and number of students enrolled is 78. In the changed circumstances, on 13th January, 2025 the petitioner made a further representation seeking for transfer on distance ground. However, the same is still pending consideration. He seeks that the matter may be relegated to the appropriate authority.
6. Mr. Gourav Das, learned Advocate representing the District Primary School Council, South 24-Parganas submits that such consideration has to be made taking into account the existing Pupil-Teacher Ratio in the said school.
7. In the above conspectus, the Chairman, District Primary School Council, South 24-Parganas, respondent no.3 is
directed to consider the representation of the petitioner dated 13th January, 2025 afresh, in accordance with law, after taking into
consideration the present status of Pupil-Teacher Ratio
3 in the said school, within a period of eight weeks from the date of communication of this order, upon notice to the petitioner.
8. The reasoned order is to be communicated to the petitioner within one week from the date of passing of such order.
9. Learned advocate for the petitioner is directed to communicate this order to the respondent no.3, the Chairman, District Primary School Council, South 24- Parganas, for necessary compliance.
10. With the above direction, the writ petition being WPA 1452 of 2026 stands disposed of.
11. It is clarified that the earlier order of rejection dated 3rd September, 2024 shall not stand in the way of fresh
consideration.
12. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
13. Interim order, if any, stands vacated.
14. All connected applications, if any, stand disposed of.
15. There shall be no order as to costs.
16. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
17. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
