JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayer: “WHEREFORE, it is prayed that this Hon'ble Court may be pleased to secure the records in CC No.1755/2023 on the file of Principal Civil Judge & JMFC., at Kanakapura, P/U/S 120(B), 114, 344, 365, 368 R/W 149 IPC, quash the entire proceedings therein, a copy of order sheet is herewith produced at Annexure-A, and pass such other order or orders as this Hon'ble Court may deem fit to grant in the facts and circumstances of the case to meet the ends of justice." - 3 - HC-KAR CNR: KAHC010487252026 NC: 2026:KHC:36547 CRL.P No. 10399 of 2026 2. Heard Smt.Shilpa Rani, learned counsel appearing for the petitioner, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Smt.Sudha D, learned counsel appearing for respondent No.3 and have perused the material on record. 3. During the pendency of the proceedings, the petitioner and respondent No.3 have settled the dispute among themselves and have filed a Joint Affidavit in that regard. The said Joint Affidavit reads as follows: “1. We submit that we are the petitioner and Respondent No.3 in the above criminal petition and are well acquainted with the facts of the case. Hence, we are competent to swear to this joint affidavit. 2. We submit that we were in love with each other for a considerable period. Out of our own free will and without any force, coercion, undue influence or inducement from any person, Respondent No.3 voluntarily accompanied the petitioner. 3. We further submit that our relationship was purely voluntary and consensual. No offence as alleged in the complaint was committed by the petitioner against Respondent No.3. 4. We respectfully submit that due to apprehension that our families would separate us, we lived away from our respective families for some time. At no point of time was Respondent No.3 wrongfully confined, kidnapped or detained by the petitioner. 5. We submit that our marriage was solemnized on 02.02.2024 according to Hindu rites and customs. - 4 - HC-KAR CNR: KAHC010487252026 NC: 2026:KHC:36547 CRL.P No. 10399 of 2026 Subsequently, our marriage has been duly registered under the provisions of the Hindu Marriage Act on 01.07.2026. 6. We further submit that out of our lawful wedlock, we have been blessed with a daughter, Baby Yeshaswini P., born on 17.04.2025, and we are happily residing together as husband and wife. 7. Respondent No.3 categorically states that she has no grievance or complaint whatsoever against the petitioner. She does not wish to prosecute the criminal case any further and has no objection if the proceedings in C.C. No.1755/2023 pending on the file of the Principal Civil Judge & JMFC, Kanakapura, are quashed. 8. We respectfully submit that continuation of the criminal proceedings would seriously prejudice our peaceful matrimonial life and adversely affect the upbringing, welfare and future of our minor daughter. 9. We further submit that this affidavit is executed voluntarily, out of our own free will, without any pressure, coercion, threat or undue influence from any person. 10. We therefore respectfully pray that this Hon'ble Court may be pleased to exercise its inherent jurisdiction under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, quash the proceedings in C.C. No.1755/2023, and pass such other order(s) as this Hon'ble Court deems fit in the interest of justice and equity.” 4. The petitioner and respondent No.3 are present before the Court and are identified by their respective counsels. 5. In the light of Joint Affidavit as quoted supra being filed by petitioner and respondent No.3 and offences not being against the State, I deem it appropriate to accept the same and - 5 - HC-KAR CNR: KAHC010487252026 NC: 2026:KHC:36547 CRL.P No. 10399 of 2026 terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
