The appellant has preferred the present miscellaneous appeal under Order 43 Rule 1 (r) of the Code of Civil Procedure, 1908 (for RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.07.29 10:40:07 +0530 2 short “CPC”), challenging the impugned order dated 26.06.2025 passed by the learned Ninth District Judge, Raipur, District Raipur (CG) in Civil Suit No.91A/2024, whereby the application filed by the appellant/plaintiff under Order 39 Rules 1 and2 read with Section 151 of the CPC has been rejected. 2. After arguing for some time, learned counsel for the appellant seeks permission to withdraw the present appeal. However, he prays that the trial Court be directed to expedite the trial and conclude the same within a stipulated period. 3. Learned counsel for the respondents did not controvert the aforesaid prayer made by counsel for the appellant. 4. On due consideration, the appellant is permitted to withdraw the present appeal. However, the trial Court is directed to expedite the trial and conclude the same as expeditiously as possible, preferably within a period of six months from the date of receipt of a certified copy of this Order. 5. Both parties are also directed to cooperate with the trial Court for expeditious disposal of the case. 6. Accordingly, the present miscellaneous appeal stands disposed of as withdrawn, with the aforesaid direction. 7. Pending interlocutory application(s), if any, stands disposed of.
