1. By the present writ petition, the petitioner is seeking following reliefs:-
“ 10.1. Call for the records the case
10.2. appropriate writ, order direction, preferably the nature of Certiorari, quashing and setting aside the recommendation dated 21.04.2026 made by the Tehsildar, Dharamjaigarh, the recommendation/report dated 07.06.2026 submitted by the Sub-Divisional Officer (Revenue), and the Dharamjaigarh, consequential order dated 10.06.2026 passed by the Collector, Raigarh;
10.3. issue appropriate writ, order or direction, preferably in the nature of Mandamus, directing the respondents to reconsider the petitioner's application for allotment of Government Nazul land bearing Plot Nos. 1675/1 and 1676/1, situated at Nazul Town, Dharamjaigarh, for construction of the Mahila Sangathan Karyalaya, strictly in accordance with law and on the basis of the reports and recommendations already available on record, without being influenced by the impugned recommendations and order; 10.4 issue any other writ, order or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case;”

Learned counsel for the petitioner after arguing for some time submits that the application dated 16.03.2022 seeking allotment of land for construction of the party office has been rejected by the concerned Collector, District Raigarh (C.G.), solely on the ground that it was not submitted by the competent/appropriate authority. It is further submitted that the petitioner may be granted liberty to submit a fresh application through the appropriate authority, as
3 indicated in the rejection order, and that the concerned Collector be directed to consider the same in accordance with law and pass an appropriate order.

Learned counsel for the State has no objection to the limited prayer of the petitioner.

Having heard learned counsel for the petitioner and considering the limited prayer made, this Court deems it appropriate to dispose of the petition by granting liberty to the petitioner to submit a fresh application before the concerned Collector through the appropriate authority, as referred to in the impugned order, within a period of 10 days from today. In the event such an application is filed, the concerned Collector shall consider and decide the same, in accordance with law, by passing an appropriate order within a period of 30 days thereafter.
