Rakib (Rejected) CRM (M) 1416 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kalna Police Station case no. 283 of 2022 dated 19.04.2022 under Sections 498A/326/3074 of the Indian Penal Code, 1860 with adding Sections 302/34 of the Indian Penal Code, 1860. And In the matter of : Rakib Sekh @ Rakib Sk ……Petitioner. Mr. Dhananjay Banerjee Mr. Archan Dutta Mr. Mahiul Islam .....for the Petitioner. Mr. Pradip Banerjee ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for four years three months, although, charges have been framed but only examination-in-chief of one witness has been completed. From the side of the accused an application under Section 231(2) of the Cr.P.C. has been filed. Learned advocate appearing for the State submits that an opportunity be granted to complete the evidence of CSW 2 and CSW 4 which is fixed on 11.09.2026. Having considered the vulnerability which has been pleaded by the learned advocate for the State, I direct the learned trial Court to conclude the evidence of the said witnesses by 30th of September, 2026. 2 As substantial time has passed in the meantime, learned trial Court if it is of the opinion that the petitioner would ensure further appearance before the learned trial Court after the aforesaid date, release the petitioner on bail on such terms and conditions as he deems fit and proper. However, learned trial Court would adhere the directions passed above. With the aforesaid observations, CRM (M) 1416 of 2026 is disposed of. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
