Memo of evidence filed on behalf of the State is taken on record. Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years and two months and only five witnesses have been examined out of the sixteen cited by the prosecution. Learned advocate for the State opposes the prayer for bail. According to the prosecution case, the petitioner fired at the deceased. Subsequent to which, he succumbed. According to the learned advocate for the petitioner, other witnesses did not support the prosecution case. Only one witness till date has supported the prosecution case before the Court.

Learned advocate for the State submits that there are vulnerable witnesses. Having considered the totality of the circumstances including the gravity and heinousness of the offence, as a last opportunity, one year time is granted to the State to complete all the witnesses including the vulnerable witnesses. At this stage, the prayer for bail of the petitioner is rejected. The learned Trial Court is directed to adhere the aforesaid directions. Accordingly, CRM (M) 1427 of 2026 is dismissed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
