JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:34278 WP No. 19434 of 2026 ORAL ORDER The present writ petition is filed seeking the following prayer: “Wherefore, the petitioners respectfully pray that this Hon’ble Court be pleased to:- a) Issue a writ in the nature of certiorari and quash the impugned order dated 12.06.2026 on I.A.No.1/2026 in M.A.No.74/2025 passed by the Addl. Sr.Civil Judge & CJM, Tumakuru as per Annexure-A to this Writ petition, and; b) Grant such other appropriate order/ orders as deem fit by this Hon’ble Court to the facts and circumstances of the case, in the interest of justice.” 2. Learned counsel for the petitioners submits that the trial court has granted an injunction. The petitioners have filed M.A.No.74/2025 with a delay of 200 and odd days. The Appellate Court has not considered the application since January. In fact, when the petitioners filed an earlier writ petition, this Court gave them liberty to seek disposal of M.A. Even after that, for the last six months, the matter has not been taken up by the Appellate Court. Hence, the petitioners are before this Court. - 4 - HC-KAR NC: 2026:KHC:34278 WP No. 19434 of 2026 3. Having heard learned counsel for the petitioner, this Court has perused the order sheet. When an M.A. is filed in January, not considering it even till July is improper. The Appellate Court ought to have considered it, and the inquiry on the IA will not take this many months for the Court to decide. Considering the urgency expressed by the petitioner and the fact that the ad-interim injunction was granted long back, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of directing the Appellate Court to decide MA No.74/2025 in accordance with law as expeditiously as possible, but not later than two months. ii.
