For Petitioner(s) : Mr.S.Sakthivel For Respondent(s) : Mr.A.R.Balaji, Government Advocate ORDER The writ petition is filed for the below relief: "directing the respondents to pay interest of 12% to the petitioners for belated payment of Gratuity, Dearness Allowance, Leave Salary, Provident Fund and Commutation of pension amount within a time frame." 2. The brief facts which are culminated in the filing of this writ petition https://www.mhc.tn.gov.in/judis WP No. 18622 of 2026 __________ Page3 of 5 are set out below: 2.1. It is the case of the petitioners that the petitioners were working as Senior Tradesman, Senior Technician, Driver, Conductor and Senior Checking Inspector respectively and retired from service after attaining their age of superannuation. The respondents settled the Gratuity, Dearness Allowance, Leave Salary, Provident Fund and Commutation of pension amount with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioner made a representation to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of the petitioner’s Gratuity, Dearness Allowance, Leave Salary, Provident Fund and Commutation of Pension amount. Since there is no response, the petitioners are before this Court. 3. Heard the learned Counsel on either side and perused the materials available on records. 4. Admittedly, the Gratuity, Dearness Allowance, Leave Salary, Provident Fund and Commutation of Pension amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petition is disposed of with a direction to the respondents to disburse the 6% interest for belated payment of Gratuity, https://www.mhc.tn.gov.in/judis WP No. 18622 of 2026 __________ Page4 of 5 Dearness Allowance, Leave Salary, Provident Fund and Commutation of Pension amount within a period of one (1) month from the date of receipt of a copy of this order.
