Sr. No.12 IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP(C) 2234/2026 CM(6075/2026) MUZAFFAR AHMAD DAR AND ANOTHER …Petitioner(s)/appellant(s) Through: Mr. Mudasir Bin Hassan, Advocate Vs. UNION TERRITORY OF J AND K AND OTHERS ...Respondent(s) Through: Mr. Faheem Nisar, GA CORAM: HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE O R D E R 14.09.2026 1. Learned counsel for the petitioners submits that the order of suspension is stigmatic and devoid of reasons for passing such order based upon criminal proceedings which were initiated in the year 2018 & 2022. The learned counsel further submits that, at this juncture, suspension is causing hardship to the family members and also creating difficult circumstances for the petitioners who are teachers. The counsel for the respondents submits that the nature of the allegations in NDPS cases is quite severe, but at this stage, he reserves his right to oppose the petition, if required. 2. This Court is of the firm opinion that unless something very extraordinary is pointed out, the petitioner ought not to have approached this Court. This Court is conscious of the fact that the learned CAT has already issued notices and, after service, the petitioners will have all the chance of making out their submissions on merits against the suspension. The notices were issued by the learned Tribunal on 03.08.2026 and the next date is 13.10.2026 and, thus, in the given circumstances, it is not a fit case where this Court needs to go into the merits of the case. 3. The petition is thus disposed of with liberty to the petitioner to take up all the issues before the learned CAT. The learned CAT shall consider all his submissions and make an endeavour to dispose of the interim application expeditiously. (RAJNESH OSWAL ) (DR. PUSHPENDRA SINGH BHATI) JUDGE CHIEF JUSTICE SRINAGAR 14.09.2026 Shameem H.
