JUSTICE P SREE SUDHA ORAL ORDER In spite of service of notice, respondent did not turn up, set ex-parte. 2. Heard the arguments of learned counsel for the petitioner. 3. This Civil Petition is filed by the petitioner/wife for transfer of M.C.No.1233/2026 filed by the respondent/husband for divorce before the Principal Judge, Family Court, Bengalore, to the Court of Principal Judge, Family Court, Chikmagaluru. 4. Learned counsel for the petitioner stated that the petitioner is residing with her parents in Chikkamagaluru along with her minor children, who were born on 25.11.2019 and - 3 - HC-KAR CNR: KAHC010304972026 NC: 2026:KHC:36837 CP No. 148 of 2026 17.07.2023 and are presently aged 6 years and 3 years respectively. The distance between Chikkamagaluru and Bengaluru is 241 kilometers. It is further stated that the petitioner cannot attend the Court proceedings without any assistance of her relatives, as there is a threat to her life. She has no independent source of income and is dependent on her father. It is also stated that the respondent-husband is not paying any maintenance. It is also submitted that previously the petitioner had filed M.C.No.120/2024 for divorce. But later she withdrew the same and thereafter the parties lived together. But the respondent-husband has now filed M.C.No.1233/2026 for divorce. 5. Therefore, considering the arguments of learned counsel for petitioner and in the absence of respondent arguments, this Court finds that it is just and reasonable to transfer M.C.No.1233/2026 from the Principal Judge, Family Court, Bengalore, to the Court of Principal Judge, Family Court at Chikmagaluru.
