Respondent No. 6 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Mr. Raha, learned Advocate representing the petitioner expresses dissatisfaction with regard to the steps taken by the concerned police authorities in investigating Bowbazar Police Station Case No. 151 dated 1st August, 2025. 3. According to the petitioner certain steps are required to be taken by the concerned police authorities while investigating the aforesaid case but there is inaction. 2 4. State respondents and respondent no. 6 are represented by learned Advocates. 5. Since petitioner prays for direction upon the concerned police authorities to take necessary steps in connection with the investigation being carried out in aforesaid criminal prosecution, petitioner needs to approach jurisdictional Magistrate under Section 175(3) BNSS, 2023. 6. In this regard reliance is placed on the judgment of the Hon’ble Supreme Court reported in 2026 SCC Online SC 798 (Sujal Vishwas Attavar and Anr -Vs- State of Maharashtra and Others). 7. In paragraph 7 of Sujal Vishwas Attavar (supra) it has been held that if after registration of FIR parties are aggrieved due to inaction on the part of the concerned police authorities in investigating the case in that event approach has to be made within the statutory framework. 8. Hence, present writ petition is not interfered with and same stands dismissed. 9. However this order shall not preclude the petitioner to approach the jurisdictional Magistrate in accordance with law. 3 10.
