APP Ms. Panchali Deb Sikder (Nag) Mr. Atul Dong … …For the State 1. The bail prayer of the petitioner is taken up for consideration. 2. It is submitted by the learned advocate for the petitioner that the petitioner is the first wife of her husband. The victim was second wife. It is further submitted that the petitioner has been in custody for 125 days. The investigation of the case has ended in a charge sheet against the present petitioner as the sole accused, though the first information report was recorded against several 2 accused persons. The said accused persons have not been chargesheeted except the present petitioner. 3. Learned advocate for the State opposes the prayer for bail. 4. As evident from the materials placed before this Court the petitioner happens to be the first wife of her husband whereas the victim was the second wife. It appears that the petitioner used to inflict torture upon the victim. It is the petitioner who poured kerosene oil upon the victim and set her on fire. The victim was taken to hospital where she succumbed to her injuries. The court is informed that the investigation has concluded. Charges stood framed. The case is ready for trial. 5. In view of the nature of allegations, the gravity of the offence and the stage of trial, I am not inclined to the petitioner on bail. The bail prayer is rejected. 6.
