JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in Crime No.130/2025, pending before the Senior Civil Judge & JMFC at Channapatna, Ramanagar District, for the offences under Sections 143, 323, 504 read with Section 149 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Pramod K.B., learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Rajayoga K, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the petitioner No.1 and respondent No.2 have settled the dispute among themselves and have filed a Compromise Petition in M.C.No.5/2026 before the Principal Senior Civil Judge and JMFC - 5 - HC-KAR CNR: KAHC010087052026 NC: 2026:KHC:36546 CRL.P No. 1900 of 2026 Court at Channapatna and have filed a Joint Memo to that effect before this Court, which reads as follows: “1. The above Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure seeking quashing of the Complaint dated 17.10.2025, the First Information Report dated 17.10.2025 registered in Crime No.0130/2025 by M.K. Doddi Police Station, and all further proceedings arising therefrom. 2. It is respectfully submitted that during the pendency of the present Criminal Petition, the Petitioners and Respondent No.2 have amicably resolved all their matrimonial disputes through the intervention of elders and well-wishers. Pursuant thereto, the parties have entered into a comprehensive Compromise Petition in M.C.No.5/2026 before the Court of the Principal Senior Civil Judge & JMFC, at Channapatna. 3. The learned Principal Senior Civil Judge & JMFC, at Channapatna has, by Judgment and Decree dated 08.04.2026, accepted the compromise entered into between the parties and dissolved the marriage by a decree of divorce in terms of the compromise petition. The compromise forms part and parcel of the decree. 4. As one of the terms of the compromise, Respondent No.2 has unequivocally agreed to co-operate in quashing the present criminal proceedings and has undertaken not to raise any objection to the quashing of the FIR and all consequential proceedings. The parties have further agreed to withdraw all allegations made against each other and have declared that they have no subsisting claims or disputes, civil or criminal, arising out of their matrimonial relationship. 5. In view of the complete settlement arrived at between the parties and the decree passed by the competent Civil Court, the continuation of the criminal proceedings would serve no useful purpose and would amount to an unnecessary abuse of the process of law. Since the dispute is purely matrimonial in nature and has been amicably - 6 - HC-KAR CNR: KAHC010087052026 NC: 2026:KHC:36546 CRL.P No. 1900 of 2026 resolved, no useful purpose would be served by permitting the criminal proceedings to continue. 6. It is therefore just, proper and necessary that this Hon'ble Court may be pleased to exercise its inherent jurisdiction under Section 482 of the Code of Criminal Procedure to secure the ends of justice. WHEREFORE, the Petitioners and Respondent No.2 most respectfully pray that this Hon'ble Court may be pleased to: a) Allow the above Criminal Petition; b) Quash the Complaint dated 17.10.2025 (Annexure-A), the First Information Report dated 17.10.2025 (Annexure-B), and all further proceedings arising out of Crime No.0130/2025 registered by M.K. Doddi Police Station, pending on the file of the learned Senior Civil Judge & JMFC, Channapatna, Ramanagara District, for the offences punishable under Sections 143, 323, 504 read with Section 149 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, in the interest of justice and equity; and c) Pass such other order or orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice and equity.” 4. The petitioner No.1 and respondent No.2 are present before the Court and are identified by their respective counsels. 5. In the light of Compromise Petition filed in M.C.No.5/2026 before the Principal Senior Civil Judge and JMFC Court at Channapatna being filed and also a Joint Memo as - 7 - HC-KAR CNR: KAHC010087052026 NC: 2026:KHC:36546 CRL.P No. 1900 of 2026 quoted supra to that effect being filed before this Court, I deem it appropriate to accept the said Joint Memo and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Complaint and FIR both dated 17.10.2025 pursuant to Crime No.130/2025, pending before the Senior Civil Judge & JMFC at Channapatna, Ramanagar District, stands quashed qua the petitioners.
