The petitioner is the wife of the principal accused. She prays for pre- arrest bail in connection with Kharibari Police Station Case No.224 of 2026 dated 17.06.2026 under Sections 64/61(2)/351(2) of the Bharatiya Naya Sanhita 2023. 3. It is submitted that the nature of the complaint against the petitioner was that she used to blackmail the victim by referring to a video of the victim and her husband in a compromising position. 4. It appears from the complaint that the relationship between the victim and the principal accused continued for ten years. Although, learned advocate for the de facto complainant submits that the 2 petitioner used to blackmail the victim, this Court is of the view that custodial interrogation of the petitioner is not required in the facts of this case, considering the role of the petitioner. 5. Accordingly, this Court direct, that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the arresting officer and also subject to the conditions laid down in Section 482(2) of the BNSS. The petitioner will not leave the jurisdictional police station and cooperate with the investigation. In the event the condition is violated, the anticipatory bail will stand automatically cancelled. 6. The application for anticipatory bail, being CRM (A) 499 of 2026 is, thus, allowed and disposed of. 7.
