The petitioner prays for pre-arrest bail in connection with Phansidewa Police Station Case No. 296 of 2026 dated June 9, 2026 under Sections 308(2), 318(4), 351(2) of the BNS, 2023. 2. Considering the contents of the complaint filed before the police and the time gap between the date of the alleged incident and the date of the complaint, as also the alleged role of the petitioner, the prayer for pre-arrest bail is allowed. It appears that there is a political rivalry. 3. Accordingly, this Court directs that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of 2 Rs.20,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S. 2023. The petitioner shall meet the Investigating Officer once a week. The petitioner shall not leave the jurisdiction of the Phansidewa Police Station. The petitioner shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 4. In default, the jurisdictional court shall be at liberty to cancel the bail without further reference to this court. 5. The application for anticipatory bail is, thus, disposed of. 6.
