A copy of this application is served upon Mr. Ujjwal Luksom, learned counsel, who ordinarily appears on behalf of the State, in Court. Let him represent the State in this case. His engagement may be regularized in due course. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in NDPS Case No. 18 of 2021 presently pending before the learned Additional Sessions Judge (NDPS), 1st Court, Jalpaiguri. He was granted interim bail on 21.09.2015. Thereafter, he had been regularly attending the jurisdictional Court. On 09.02.2026, due to certain exigencies, he could not appear before the learned trial Court. Even steps could not be taken. Accordingly a warrant of arrest issued against him. He wants to join the proceeding at the earliest. Heard the learned counsel for the State.
2 It appears that the petitioner could not attend the trial Court on a particular date due to some unforeseen circumstances. Consequently, a warrant of arrest has been issued. He wants to join the proceeding at the earliest. In view of the above and in the interest of justice, let the warrant of arrest issued against the petitioner remain stayed for a period of four weeks from this date. The petitioner shall surrender before the learned trial Court within such time and pray for bail. In such event, the petitioner’s prayer for bail shall be considered in accordance with law. With these observations and directions, the revisional application is disposed of. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
