The petitioners pray for pre-arrest bail in connection with Sitalkuchi Police Station Case No.151 of 2026 dated April 2, 2026 under Sections 126(2), 118(2), 109/3(5) of the BNS, 2023. 2. Considering the contents of the complaint, the fact that there is a case and counter-case against each other and as the dispute is over landed property, the Court is of the opinion that the custodial interrogation of the petitioners will not be necessary in this case. The injury report is also perused. 3. Accordingly, this Court directs that, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.20,000/- each, with two sureties of like amount each, one of 2 whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S. 2023. The petitioners shall meet the Investigating Officer once a week. The petitioners shall not leave the jurisdiction of the Sitalkuchi Police Station. The petitioners shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 4. In default, the jurisdictional court shall be at liberty to cancel the bail without further reference to this court. 5. The application for anticipatory bail is, thus, disposed of. 6.
