IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-28193-2026 Date of Decision:15.07.2026 Harpreet Singh @ Preet
…Petitioner Vs. State of Punjab
…Respondent
Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Aditya Partap, Advocate Mr. Pranjal Goel, Advocate Mr. Durgesh Barana, Advocate for the petitioner. Mr. Amit Rana, Sr. DAG, Punjab. *** N.S.Shekhawat J. (Oral)
1. The petitioner has filed the present petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.137, dated 08.08.2025, registered under Sections 103(1), 190,191,61(2) of B.N.S {Corresponding Sections 302,149, 147,148,120-B of IPC} at Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib, Punjab (Annexure P-1).
2.
Learned counsel for the petitioner contends that the F.I.R in the present case was registered on the basis of the statement made by Pargat Singh. Even, as per the version of the complainant as mentioned in the F.I.R (Annexure P-1), the petitioner had allegedly gone to the house of the complainant and made enquiries about Angrej Singh @ Ginnu, since deceased. The complainant told the petitioner that Angrej Singh @ Ginnu was not presented at home. CRM-M-28193-2026 -2 Ultimately, the petitioner allegedly instructed the complainant to send the deceased to Barkandi Tibbi. As per the complainant, when Angrej Singh @ Ginnu reached at the house of Shiva, he was brutally assaulted by Kulwinder Singh @ Lucky, Karan Sharma, Jaswinder Singh @ Kali, Shiva and Shani. As per the case of the prosecution, the petitioner was not present at the place of occurrence and his case was clearly distinguishable from the case of other five accused, who had caused specific injuries to the deceased. Learned counsel further submits that the petitioner was arrested in the present case on 17.08.2025 and challan has already been presented against him. Apart from that, there was no material to indicate that he is in a position to influence the witnesses of the prosecution. 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and the present petition deserves to be dismissed by this Court. 4. I have heard the learned counsel for the parties and perused the record carefully. 5. In the present case, admittedly, the petitioner was not present at the place of occurrence and had not caused any injury to the deceased. The case of Kulwinder Singh @ Lucky, Karan Sharma, Jaswinder Singh @ Kali, Shiva and Shani is entirely on different footing. The only allegation against the petitioner was that he had gone to the house of the deceased to enquire about him and when he did not find him at home, he returned at home after instructing the complainant. Apart from that, no other role has been attributed to him.
