Two bail applications are taken up together as they emanate out of the same police case. 2. Heard learned advocate for the petitioners in the both the bail applications. 3. It is submitted by learned advocate for the petitioners that the petitioners are alleged to have assaulted the complaining party. As a result of such assault, death of the victim occurred. It is submitted by learned advocate for the petitioners that all other accused persons except these two petitioners have been granted bail. The investigation of the case has concluded and chargesheet has been submitted as against 22 accused persons. The other accused persons were granted bail by the jurisdictional Court. The present petitioners have been in custody for more than six months. Learned advocate for the petitioners prays for release of the petitioners on bail. 4. Learned advocates appearing for the State refers to various materials in the Case Diary. He submits that there is no chance of absconsion if the petitioners are enlarged on bail. 5. Heard learned advocates for the State. State opposes the prayer bail of the petitioners. 6. Learned advocate for the de facto complainant submits that the accused persons granted bail have been 3 intimidating the witnesses. She opposes the prayer for bail of the petitioners. 7. Upon hearing the learned advocate for the parties and on perusal of materials of the Case Diary it appears that, petitioners are in custody for more than six months. The materials in the Case Diary suggests that present petitioner in CRM(M) 170 of 2026 was armed with bamboo with which he assaulted the victim. 8. 9 accused persons have already been granted bail by the jurisdictional Court. The investigation of the case has already concluded in a chargesheet. There is hardly any possibility of trial concluding in near future. 9. Consequently, prayer for bail of the petitioners is granted. 10. Accordingly, I direct that the petitioners namely, Pintu Sikdar and Sudhir Shikdar shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Mathabhanga, subject to condition that the petitioners shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. 11. In the event petitioners fail to appear before the trial court without any justifiable cause, the trial court shall be at 4 liberty to cancel his bail in accordance with law without further reference to this Court. 12. The applications for prayer for bail are allowed. 13. CRM(M) 170 of 2026 and CRM(M) 171 of 2026 are disposed of. (Md. Shabbar Rashidi, J.)
