JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.3 in S.C.No.33/2026 pending before the Court of Prl. District & Sessions Judge, Chamarajanagar, arising out of Crime No.188/2025 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 75, 80 & 81 of Juvenile Justice (Care and Protection of Children) Act, 2015, and Section 93 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.188/2025 was registered by Chamrajanagar Town Police Station, for the offences punishable under Section 75 of Juvenile Justice (Care and Protection of Children) Act, 2015, and Section 93 of BNS, 2023, against Manjunayaka and his wife Smt. Sindhu based on the first information dated 20.09.2025 recceived from Nagesh.M., who is the husband of accused no.2. In the said case, petitioner was arrested on 23.01.2026 and remanded to judicial custody. After - 3 - HC-KAR CNR: KAHC010468482026 NC: 2026:KHC:37247 CRL.P No. 10115 of 2026 completing investigation, charge sheet is filed against six persons and petitioner is arrayed as accused no.3 in the charge sheet. Her bail application filed before the Trial Court in S.C.No.33/2026 was rejected 12.05.2026. Therefore, she is before this Court. 4. Perusal of the first information as well as the charge sheet filed in the present case would go to show that accused no.2 is the wife of CW-1 and from their wedlock, they have a son aged about three years. Accused no.1 is the uncle of accused no.2 and it appears that accused no.2 had illicit relationship with accused no.1, and therefore, she had abandoned her husband and started living with accused no.1 - Manju Nayaka. Accused no.2 who was pregnant, subsequently gave birth to girl child in Chamarajanagar District Hospital on 26.07.2025 and since accused nos.1 & 2 did not want to take care of the girl child, with the help of accused no.3 who was working as Group-D employee in the hospital, they had allegedly illegally sold the new born girl child to accused nos.4 & 5. Subsequently, the girl child had died in Cheluvamba Hospital due to ill-health. Accused nos.1, 2, 4 & 5 who were - 4 - HC-KAR CNR: KAHC010468482026 NC: 2026:KHC:37247 CRL.P No. 10115 of 2026 arrested in the present case have been granted regular bail by this Court in Crl.P.No.7752/2026 disposed of on 03.07.2026. 5. Considering the nature of allegations against the petitioner, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.33/2026 pending before the Court of Prl. District & Sessions Judge, Chamarajanagar, arising out of Crime No.188/2025 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 75, 80 & 81 of Juvenile Justice (Care and Protection of Children) Act, 2015, and Section 93 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the - 5 - HC-KAR CNR: KAHC010468482026 NC: 2026:KHC:37247 CRL.P No. 10115 of 2026 Trial Court exempts her appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against her is disposed off.
