We appreciate the agony of the petitioner that although the matter was pending before the tribunal since long, due to non-functioning of the tribunal the matter could not be taken up. The petitioner is 80 years old. 2. Learned AGP raised the question of maintainability and submits that the petitioner ought to have moved the writ court. 3. We agree with the submission of the learned AGP. Accordingly, the petitioner is at liberty to move the writ court on the self-same issue which is pending before the tribunal. 2 4. It is made clear that if the writ petition is disposed of, the original application filed in the tribunal will become infructuous. 5. Accordingly, WPST 4 of 2026 is disposed of. 6.
