(Presently Confined At District Jail, Deeg). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Arvind Sharma with Ms. Manju Chouhan For Respondent(s) : Mr. Jaiprakash Tiwari, PP Mr. Kartar Singh Faujdar HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 28/04/2026
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.515/2025 registered at Police Station Kumher, District Deeg for offences under Sections 189(2) and 103(1) of BNS, 2023.
2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as learned counsel for the complainant and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that in the present matter, the complainant-Gopal Singh lodged an FIR regarding the murder of his brother Mahesh Chand. He argues that complainant-Gopal Singh who was examined before the learned trial Court as PW-3 has not supported the prosecution case and has turned hostile. Similarly the eye-witnesses PW-1 Uday and PW-2 Rajendra have also not supported the prosecution
[2026:RJ-JP:17839] (2 of 2) [CRLMB-125/2026] case and have turned hostile. The testimonies of the other eye- witnesses PW-4 Pooja and PW-5 Dehati (wife of the deceased) also do not support the prosecution case. Thus, PW-1 to PW-5 have all turned hostile. It is submitted that in view of these circumstances, it would be futile to keep the accused incarcerated. Petitioner is behind the bars since 26.08.2025 though one case been reported against him but in that case he is already on bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed.
4. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Prahlad Singh @ Pintu S/o Bhagwansingh @ Parsadi, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
