JUSTICE MRIDUL KUMAR KALITA ORDER 10.02.2026 1. Heard Ms. Vanlalthlamuani, learned counsel for the applicant. Also heard Ms. Laltlanhlui, learned counsel for the respondent No. 2. 2. This application under Order 22 Rule 3 of the Code of Civil Procedure, read with Section 151 of the said Code has been filed for substitution of the deceased appellant in the connected Regular First Appeal No. 27/2024. 3. The learned counsel for the applicant has submitted that the appellant of RFA No. 27/2024 had expired on 09.11.2025 and therefore, there is a necessity of substituting the deceased appellant by his legal heir in the Page No.# 3/3 connected RFA. She submits that the instant substitution application has been filed within the period of limitation of 90 days from the death of the appellant. The prayer is not opposed to by the learned counsel for the respondents. Hence, the same is allowed. 4. Let the deceased appellant i.e., Sh. Zosangliana be substituted by his wife Smt. R.K. Lalbiaksangi in the connected RFA No. 27/2024. The applicant shall file corrected cause title in the Memo of Appeal filed in the connected RFA. 5. This Interlocutory Application is accordingly disposed. 6. Let the connected appeal be listed after two (2) weeks after filing of the corrected cause title by the applicant. JUDGE Comparing Assistant
