The petitioner prays for pre-arrest bail in connection with Mathabhanga Police Station Case No.182 of 2026 dated 11.03.2026 under Sections 137(2)/140(3)/49 of the BNS 2023 read with Section 6 of the POCSO Act. 3. Learned advocate appearing for the State opposes the prayer for anticipatory bail of the petitioner. 4. Considering the role of the petitioner in the alleged offence and the contents of the complaint as also the statement of the victim recorded under Section 180 of the BNSS, the Court is inclined to grant pre- arrest bail. The Court is of the view that custodial interrogation of the mother of the accused is not required. 2 5. Accordingly, this Court directs that, in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of the whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The further condition is that the petitioner shall cooperate with the investigation and will not leave the jurisdiction of Falakata police station. 6. In case the petitioner fails to adhere to any of the conditions as stated above, the anticipatory bail automatically stands cancelled. 7. The application for anticipatory bail is, thus, allowed and disposed of. 8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
