JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition is filed under Section 482(i)(b) of BNSS 2023, seeking relaxation/modification of the condition No.(i) imposed by this Court in the anticipatory bail order dated 26.05.2026 passed in Criminal Petition No.7376/2026. 2. Heard the learned Counsel for the parties. 3. The petitioner had approached this Court in Criminal Petition No.7376/2026 seeking anticipatory bail in Crime No.21/2026, registered by Dakshina Kannada Women Police Station, for the offences punishable under - 3 - HC-KAR CNR: KAHC010383282026 NC: 2026:KHC:36496 CRL.P No. 8020 of 2026 Sections 196(1), 352, 351(2), 79 of BNS, 2023. The said petition was allowed by the Co-ordinate bench of this Court on 26.05.2026 and the petitioner was granted anticipatory bail subject to certain conditions. Condition No.(i) imposed by this Court in Criminal Petition No.7376/2026, reads as follows: " i. He shall execute a personal bond for Rs.2,00,000/- (Rupees Two lakhs only) with a solvent surety for the likesum and to the satisfaction of the Trial Court." The petitioner is before this Court in this petition seeking modification of the aforesaid condition No.(i). 4. Learned Counsel for the petitioner submits that the Sub-Divisional Magistrate, Puttur, has passed an externment Order against the petitioner on 13.03.2026 externing the petitioner to the jurisdiction of Manvi Police Station, Raichur District for the period from 13.03.2026 to 16.09.2026. Therefore, the petitioner is not able to comply with the condition No.(i) imposed in the anticipatory bail - 4 - HC-KAR CNR: KAHC010383282026 NC: 2026:KHC:36496 CRL.P No. 8020 of 2026 order dated 26.05.2026 passed in Criminal Petition No.7376/2026. 5. Learned High Court Government Pleader does not seriously oppose the prayer made in the petition and submits that the petitioner may be directed to appear before the Investigating Officer, immediately after the externment period is over. 6. Submissions made on both sides are placed on record. 7. Criminal petition is allowed. Condition No.(i) imposed by this Court in the order dated 26.05.2026 passed in Criminal Petition No.7376/2026 granting anticipatory bail in Crime No.21/2026, registered by Dakshina Kannada Women Police Station, for the offences punishable under Sections 196(1), 352, 351(2), 79 of BNS, 2023, is hereby modified and the same shall read as follows: - 5 - HC-KAR CNR: KAHC010383282026 NC: 2026:KHC:36496 CRL.P No. 8020 of 2026 i. He shall appear before the Investigating Officer of the present case on or before 22.09.2026 and execute a personal bond for a sum of Rs.2,00,000/- (Rupees Two Lakhs only) with two sureties for the likesum to the satisfaction of the Investigating Officer.
