Learned counsel for the petitioner submits that the petitioner has applied for appointment to the post of Anganwadi Worker for Ward No. 4, Chhuikhadan. It is submitted that the petitioner had applied under the BPL category as a deserted woman and, in terms of the advertisement, was entitled to additional marks. However, while other similarly situated candidates belonging to the BPL category have been awarded the benefit of such additional marks, the petitioner has been denied the same. Aggrieved thereby, the petitioner has submitted a representation before the competent authority, which is placed on record as Annexure P-6, but no decision has yet been taken thereon. 2. Learned State counsel, on instructions, submits that if the representation submitted by the petitioner before respondent No. 5 is pending consideration, the same shall be examined and decided strictly in accordance with the terms and conditions of the advertisement and the applicable rules. 3. I have heard learned counsel for the parties and perused the material available on record. 4. Considering the limited prayer made by the petitioner and the statement made by learned State counsel, without expressing any opinion on the merits of the claim, this writ petition is disposed of with a direction to respondent No. 5 to consider and decide the petitioner's representation dated Annexure P-6, if the same is still pending, by passing a reasoned and speaking order strictly in accordance with the terms of the advertisement and the 3 applicable rules, within a period of 10 days from the date of receipt of a certified copy of this order. 5. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim, and the competent authority shall take an independent decision in accordance with law. 6.
