JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in Crime No.41/2026 pending before the 9th Addl. Chief Judicial Magistrate at Bengaluru, for the offences under Sections 115(2), 126(2), 351(2) read with Sections 3(5), 352 of BNS, 2023. - 4 - HC-KAR CNR: KAHC010365672026 NC: 2026:KHC:36242 CRL.P No. 7655 of 2026 2. Heard Sri.Suresh S, learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.T.R.Rajagopal, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application in that regard. The compounding application reads as follows: “APPLICATION UNDER SECTION 359 (2) BNSS, SEEKING PERMISSION TO COMPOUND THE OFFENCE The Complainant / Respondent No.2 and the Accused/petitioners are most respectfully submitting as follows: 1. That the petitioners in the above case, petitioner challenged the FIR registered against petitioners for the offence punishable Under Sections 115 (2), 126(2), 351(2), R/w 3 (5), 352 of BNS 2023 pending before the Hon'ble 9th Addl. Chief Judicial Magistrate at Bengaluru, registered by respondent No.1 police in Crime. No.41/2026, at Bengaluru, which are compoundable in nature. 2. The petitioners and respondent No.2 intending to settle the dispute /Galata, but the respondent No.1 police was not supporting to ends the matter only ground that the petitioners was out of state and influential persons due to the reason the respondent No.1 police intentionally harass the - 5 - HC-KAR CNR: KAHC010365672026 NC: 2026:KHC:36242 CRL.P No. 7655 of 2026 petitioners. The petitioners and respondent No.2's shop located in the same area and locality. Hence, both are intending to ends their matter amicably, the respondent No.2 personally was approached the respondent No.1 police station and state that they are ready to withdraw the complaint and stating that both are already settle the issue. Hence, the respondent No.2 requesting the respondent No.1 police to close the issue and very next day of incident, but the respondent No.1 police was not co-operating and direct the respondent No.2 was come and appear before the jurisdictional magistrate to co-operate the investigation, the respondent No.2 have no legally knowledge due to undue influence of the respondent No.1 police was appear before the jurisdictional magistrate in the time of permission was taken. 3. That due to the intervention of elders / well- wishers, the parties have amicably settled the dispute out of their free will, without any force, coercion, or undue influence. 4. That the complainant states that the dispute has been resolved fully and finally and has no objection for compounding the offence and for acquittal of the accused. 5. That the compromise has been entered into voluntarily in order to maintain peace and cordial relations between the parties. 6. That the present application is filed jointly by the complainant and the accused for recording the compromise and to pass appropriate orders in accordance with law. 7. That allowing this application would meet the ends of justice and prevent abuse of process of law. WHEREFORE, The Petitioners and respondent No.2/complainant are most respectfully prays that, this Hon'ble Court May be pleased to Quash the FIR registered - 6 - HC-KAR CNR: KAHC010365672026 NC: 2026:KHC:36242 CRL.P No. 7655 of 2026 by the 1st respondent police against the petitioners in Crime No.41/2026 for the offences punishable Under Sections 115 (2), 126(2), 351(2), R/w 3 (5), 352 of BNS 2023 pending before the Hon'ble 9th Addl. Chief Judicial Magistrate at Bengaluru vide Annexure-A in the above case in the interest of justice. vide Annexure-A in the above case and permit the parties to compound the offence under Sections 115 (2), 126(2), 351(2) R/w 3 (5), 352 of BNS 2023. And record the compromise entered between the parties; and acquit/quash the FIR against the accused in accordance with law, in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed as quoted supra and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 6.
