1. The present petition has been filed by the petitioner calling in question the inaction on the part of the respondent authorities in not considering and deciding the petitioner's application for correction of the date of birth in the academic records and Marks Statements-cum-Certificates of Class X and XII issued by the Central Board of Secondary Education (‘CBSE’), despite the application having been submitted within the prescribed period. The petitioner has prayed for following relief(s) :-
“10.1. Call for the entire records of the case for its kind perusal.
10.2. Direct the Respondent Authorities to take appropriate steps by scrutinizing the documents of the Petitioner and accordingly rectifying the typographical error of date of birth of Petitioner in the academic records and marksheet of X & XII Standards within a stipulated time period of 30 days.
10.3. Direct the Respondent Authorities to correct the date of birth of Petitioner in the academic records and marksheet of X & XII Standards from "31.08.2005" to "31.12.2004" by reissuing the marksheets of X & XII Standards in the interest of justice, and / or;

10.4. Pass any other order as it may deem fit, in the interest of justice.
10.5. Award the costs of this petition to the Petitioner.”

Learned counsel for the petitioner submits that the petitioner had submitted an application dated 02.09.2021 before the competent authority seeking correction of her date of birth in the CBSE records. It is submitted that the said application has been filed within the time prescribed under the applicable regulations and the petitioner would be satisfied if a direction is issued to the respondent-CBSE to consider and decide the said application expeditiously in accordance with law.

Learned counsel appearing for the respondent-CBSE submits that if the petitioner's application has been submitted in accordance with the applicable regulations, the same shall be considered and decided expeditiously by the competent authority in accordance with law.
4. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the petitioner's claim, the present petition is disposed of with a direction to the respondent- CBSE to consider and decide the petitioner's application dated 02.09.2021, stated to have been filed within the prescribed period,
4 strictly in accordance with law and the applicable regulations, by passing a reasoned and speaking order, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a certified copy of this order.
6. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim and the competent authority shall take an independent decision in accordance with law.
7. With the aforesaid observations/directions, instant writ petition stands disposed of. No order as to costs.
